By accessing, registering for, or using the services provided by Vigopex LLC (“Vigopex,” “we,” “our,” or “us”), you agree to be bound by these Terms & Conditions, our Privacy Notice, Prohibited Items Policy, Shipping & Storage Policy, Refund & Claims Policy, and all applicable laws and regulations. If you do not agree with these Terms, you must not use our services.
Vigopex provides two core services: (i) parcel consolidation and forwarding from the United States (Miami, Florida) to Haiti, via air or sea cargo; and (ii) document forwarding from Haiti to the United States, via air cargo only. All shipments processed by Vigopex include tracking as an integrated feature of the service. Vigopex acts solely as a non-carrier logistics intermediary and does not hold carrier authority. Vigopex may utilize third-party air cargo carriers, sea cargo carriers, and domestic delivery companies to fulfill its services.
Customers agree to provide accurate, truthful, and current information when creating or maintaining accounts. By submitting any package, cargo, or document shipment to Vigopex, the customer represents and warrants that: (i) all declarations are truthful and complete; (ii) the shipment complies with all applicable laws; (iii) the customer is the lawful owner or authorized sender of the shipment; and (iv) the shipment does not contain prohibited or restricted items or documents. Customers remain fully responsible for all activity conducted under their account.
Vigopex reserves the right to conduct compliance reviews, customer due diligence, identity verification, shipment inspections, and sanctions screening on any customer, shipment, sender, recipient, or transaction at any time. Customers acknowledge and agree that Vigopex may process searches against sanctions, restricted party, anti-money laundering, anti-terrorism financing, customs, and government watchlists, including but not limited to the United States Department of the Treasury Office of Foreign Assets Control (“OFAC”) sanctions lists. Vigopex reserves the right to refuse, suspend, cancel, delay, report, or permanently terminate any account or shipment suspected of violating applicable laws, sanctions regulations, anti-money laundering rules, or internal compliance standards.
Estimated delivery timelines are provided for convenience only and are not guaranteed. Delays may occur due to customs inspections, government actions, transportation disruptions, airline or maritime delays, weather conditions, force majeure events, operational interruptions, or security inspections. Vigopex shall not be liable for delays beyond its reasonable control.
Customers are strictly prohibited from shipping illegal, hazardous, fraudulent, restricted, or prohibited items, including but not limited to firearms, ammunition, explosives, narcotics, hazardous chemicals, counterfeit goods, undeclared cash, live animals, prohibited adult materials, obscene content, and any item prohibited under United States law, Haitian law, carrier regulations, or international transport regulations. Vigopex reserves the right to inspect, refuse, surrender, destroy, dispose of, or report prohibited shipments without compensation. For prohibited document types, see Section 7B.
Vigopex provides document forwarding services for the movement of physical documents from Haiti to the United States via a two-leg logistics model: international air cargo from Haiti to Miami, Florida, operated by a third-party air cargo carrier, followed by domestic final delivery within the United States via one or more third-party domestic carriers selected by Vigopex at its sole discretion. The following subsections govern all document shipments handled by Vigopex.
Vigopex accepts the following categories of documents for forwarding services, subject to all applicable legal requirements and carrier regulations: (i) personal identification and civil status documents, including passports, national identity cards, birth certificates, marriage certificates, and death certificates; (ii) legal and commercial documents, including contracts, agreements, notarized documents, powers of attorney, corporate records, property deeds, and court documents; (iii) academic records, including diplomas, transcripts, and professional certifications; (iv) medical records and health documents, provided they do not contain controlled substance prescriptions or restricted pharmaceutical information in violation of applicable law; (v) financial documents, including bank statements, loan documents, and insurance policies not constituting negotiable instruments; and (vi) government and official documents issued by duly authorized Haitian or other governmental authorities. Vigopex reserves the right to reject any document category at its sole discretion based on legal, compliance, or operational considerations.
The following document types are strictly prohibited from Vigopex document forwarding services and may not be submitted under any circumstances: (i) forged, falsified, counterfeit, or fraudulently altered documents of any kind; (ii) counterfeit identification documents, fraudulent immigration documents, or fraudulent travel documents; (iii) negotiable instruments, currency, checks, money orders, bearer bonds, or other financial instruments capable of being converted to cash; (iv) documents containing classified, restricted, or state secret information under United States law or Haitian law; (v) documents constituting or facilitating illegal activity, including but not limited to fraud, money laundering, human trafficking, or narcotics trafficking; (vi) obscene or prohibited materials; and (vii) any document whose transport is prohibited under United States law, Haitian law, carrier regulations, or applicable international conventions. Vigopex reserves the right to inspect, refuse, surrender to authorities, destroy, or report any prohibited document shipment without compensation and without prior notice to the customer.
Customers submitting document shipments to Vigopex represent and warrant that: (i) all documents are lawful, authentic, and compliant with all applicable laws and regulations; (ii) the customer is the lawful owner, authorized sender, or duly authorized agent of the sender with full legal authority to transmit the documents; (iii) all declarations provided to Vigopex regarding document content, origin, destination, and purpose are accurate and complete; (iv) the documents do not contain forged, fraudulent, or falsified content; and (v) the customer has complied with all applicable Haitian export requirements and United States import requirements governing the document type. Vigopex is not a law firm, immigration consultant, notary, government agency, or document authentication authority, and does not verify the legal validity, authenticity, or enforceability of any document submitted by customers. The customer bears sole and exclusive legal responsibility for the content, authenticity, and lawfulness of all documents tendered to Vigopex.
Document shipments handled by Vigopex travel under a two-leg logistics model. The international leg, from Haiti to Miami, Florida, is operated by a third-party air cargo carrier under its own terms, conditions, and tariffs. The domestic leg, from Vigopex’s Miami-area facility to the final United States destination address, is operated by one or more third-party domestic carriers selected by Vigopex, each operating under their respective published terms of service, service guides, and carrier regulations. By using Vigopex document forwarding services, customers acknowledge and agree that: (i) each carrier leg is governed by that carrier’s published terms and applicable law; (ii) Vigopex acts solely as a non-carrier logistics intermediary and coordination service and does not hold carrier authority on either leg; and (iii) Vigopex reserves the right to select, change, or substitute any carrier on either leg at its sole discretion without prior notice to the customer.
Vigopex tenders all domestic document shipments to third-party domestic carriers as the shipper of record. Vigopex does not carry, transport, or deliver shipments itself on any leg of the journey. Domestic carrier selection is made by Vigopex at its sole discretion based on operational, legal, and compliance considerations applicable to each shipment. All domestic document shipments are subject to applicable United States federal, state, and local laws and regulations, as well as the published terms and conditions of the selected domestic carrier. Vigopex reserves the right to designate or change the domestic carrier for any document shipment at any time without prior notice to the customer.
Customers are responsible for ensuring that documents are properly prepared and packaged prior to submission to Vigopex. Documents must be: (i) placed in sealed, durable envelopes or protective packaging appropriate for international air cargo handling; (ii) clearly labeled with the sender’s full name, contact information, and Vigopex customer account number; (iii) accompanied by an accurate Vigopex Document Declaration Form identifying the document type, quantity, and intended recipient; and (iv) free of loose cash, negotiable instruments, jewelry, or any non-document items. Vigopex reserves the right to repackage documents at the customer’s expense if original packaging is deemed inadequate for safe transport. Vigopex shall not be liable for damage, loss, or deterioration of documents attributable to inadequate packaging by the customer.
Vigopex acknowledges that document shipments may contain sensitive personal, legal, medical, or financial information. Vigopex employees and contractors who handle document shipments are subject to confidentiality obligations. Vigopex does not read, copy, photograph, reproduce, or disclose document content except as required by applicable law, regulatory obligation, court order, or lawful government authority. Notwithstanding the foregoing, customers acknowledge and agree that: (i) Vigopex’s confidentiality obligations do not apply where disclosure is required by law, regulation, customs authority, or court order; (ii) Vigopex is not liable for any disclosure of document content required by a government authority or law enforcement agency; (iii) customers assume all risk of interception, loss, or disclosure during transit by third-party carriers; and (iv) Vigopex is not responsible for and does not guarantee the confidentiality of document contents during carrier transit outside of Vigopex’s direct custody.
Customers acknowledge that all document shipments entering the United States are subject to inspection, examination, seizure, or detention by United States Customs and Border Protection (CBP), the Transportation Security Administration (TSA), or other applicable federal, state, or local government authorities. Vigopex has no authority to prevent, contest, or interfere with any such government action. Vigopex shall cooperate fully with all lawful government requests, orders, and inspections. Customers are solely responsible for ensuring that all documents comply with United States import regulations and, where applicable, with applicable Haitian export regulations governing the document type. Vigopex shall not be liable for any loss, delay, seizure, destruction, or damage to documents resulting from any government inspection, customs action, or regulatory enforcement.
Vigopex’s maximum liability for any document shipment lost, damaged, or delayed while in Vigopex’s direct custody shall be strictly limited to the transportation service fee paid by the customer for that specific shipment, unless the customer has purchased and been approved for additional Declared Value Coverage at the time of shipment booking. Vigopex shall not be liable for the intrinsic, sentimental, legal, immigration, academic, financial, or consequential value of any document, regardless of its nature or importance to the customer. Customers are strongly advised to retain certified copies of all documents prior to submission. For documents of significant legal or personal importance, customers are advised to consult an attorney or appropriate professional regarding alternative transmission methods. Vigopex does not offer insurance coverage for document shipments through its standard Declared Value Coverage program; document shipment coverage, if available, is governed by the applicable carrier’s published terms and the customer’s selected service level.
Vigopex will provide customers with tracking information for the domestic carrier leg of document shipments. Tracking updates are informational estimates only and do not constitute a guarantee of delivery status or timing. Proof of delivery, where available, shall be provided by the final domestic carrier and is subject to that carrier’s published terms. Vigopex does not provide tracking for the international air cargo leg beyond confirmation of departure from Haiti and arrival at the Miami facility. Customers are responsible for monitoring tracking updates and promptly notifying Vigopex of any delivery exceptions, failed delivery attempts, or address corrections required.
Customers are responsible for providing accurate declarations and complying with all import/export laws, customs regulations, sanctions laws, and governmental requirements. Customers remain solely responsible for all duties, taxes, customs charges, penalties, inspection fees, storage fees, and governmental assessments associated with shipments. Vigopex does not guarantee customs clearance.
This section applies to Vigopex’s parcel consolidation and forwarding service (United States to Haiti) only. Document forwarding shipments (Haiti to United States) are delivered directly to the recipient’s address via a third-party domestic carrier and are not subject to customer pickup. For parcel shipments, customers are responsible for retrieving shipments promptly following notification of availability at the designated pickup location. Parcels not picked up within 15 calendar days after notification will begin accumulating storage fees at a rate of $1.00 USD per day per shipment. All outstanding balances and storage fees must be paid before release. Shipments remaining unclaimed for more than 60 calendar days may be considered abandoned, and Vigopex reserves the right to dispose of, liquidate, donate, or return shipments at the customer’s expense in order to recover unpaid balances, storage charges, and operational costs.
Vigopex reserves the right, but not the obligation, to open, inspect, scan, verify, refuse, delay, or investigate any shipment, package, cargo, or document at any time without prior notice. Vigopex may cooperate fully with customs authorities, law enforcement agencies, regulators, transportation partners, and government entities.
To the maximum extent permitted by law, Vigopex acts solely as a logistics intermediary and transportation coordinator. Vigopex shall not be liable for indirect, incidental, consequential, punitive, emotional distress, reputational, immigration-related, academic, business, or economic damages arising from use of its services. Unless additional insurance coverage is expressly approved in writing, Vigopex’s maximum liability for any package or shipment shall not exceed the lesser of the documented declared value or $100 USD per shipment. For document forwarding services, Vigopex’s maximum liability shall be strictly limited to the transportation service fee paid by the customer. Vigopex shall not be liable for customs seizures, confiscations, delays, improper packaging, inaccurate declarations, fraudulent documents, transportation interruptions, force majeure events, or actions of third parties.
Tracking updates are informational estimates only and are not guarantees of delivery status. By using Vigopex services, customers consent to receiving operational communications through email, SMS/text messaging, WhatsApp, phone calls, or other communication channels for shipment updates, account notifications, customer support, verification requests, and operational alerts. Standard carrier or messaging fees may apply.
All applicable shipping charges, storage fees, customs-related charges, duties, taxes, penalties, and operational costs must be paid prior to shipment release unless otherwise authorized. Shipping and operational fees become non-refundable once shipment processing, cargo preparation, customs handling, transportation scheduling, or shipment departure has begun. Vigopex reserves the right to withhold shipments until all balances are settled.
Customers agree not to initiate fraudulent chargebacks, payment reversals, or abusive disputes for services properly rendered. Vigopex reserves the right to suspend accounts, deny future services, initiate collections activities, or pursue legal remedies in cases involving suspected fraud, abuse, or payment disputes.
Customers may not attempt unauthorized access to Vigopex systems, interfere with platform security, use automated scraping technologies, submit fraudulent information, misuse customer accounts, or use Vigopex services for unlawful purposes. Vigopex reserves the right to restrict or terminate platform access without notice.
All Vigopex content, branding, logos, graphics, software, workflows, text, website content, and operational systems remain the exclusive property of Vigopex LLC and may not be copied, reproduced, distributed, modified, or exploited without prior written authorization.
Vigopex may cooperate or integrate with third-party air cargo carriers, sea cargo carriers, domestic delivery companies, payment processors, shipment tracking platforms, or other technology and operational service providers. Vigopex shall not be liable for failures, outages, delays, actions, or omissions caused by any third-party provider.
Vigopex shall not be liable for delays, interruptions, losses, or failures caused by events beyond its reasonable control, including natural disasters, political instability, civil unrest, customs actions, labor strikes, transportation disruptions, weather events, government restrictions, cyber incidents, system failures, or force majeure events.
You agree to defend, indemnify, and hold harmless Vigopex LLC, its officers, employees, affiliates, contractors, representatives, and partners from and against any claims, damages, liabilities, penalties, losses, expenses, investigations, or legal actions arising from your shipments, documents, declarations, misuse of services, violations of law, or breach of these Terms & Conditions.
These Terms & Conditions shall be governed and interpreted under the laws of the State of Florida, United States, without regard to conflict of law principles. Any dispute arising from Vigopex services shall be resolved exclusively in courts located within the State of Florida.
If any provision of these Terms & Conditions is determined to be invalid, unlawful, or unenforceable, the remaining provisions shall remain fully enforceable to the maximum extent permitted by law.
Vigopex reserves the right to modify or update these Terms & Conditions at any time without prior notice. Continued use of Vigopex services constitutes acceptance of revised Terms & Conditions.
